Terms & Conditions and Conditions of Carriage
Hereinafter “ the company “ means Zanzibar Excursions its directors, owners, employees, affiliates, service providers, agents, boat owners and transporters

1. Contract
All bookings taken by the company are subject to this terms and conditions and the conditions of carriage
2. Quotations and Availability
A quotation is an offer to provide services and is subject to changes. An agreement is only concluded once the full price is paid for in full. The prices are subject to change, including changes due to errors and omissions and may only be confirmed when paid in full. Please note that quotes provided are subject to availability. The price quoted can never be guaranteed unless specifically guaranteed and all offers, are subject to change for reasons and prior to payment in full
3. Payments and cancellations
Unless otherwise offered, a deposit as agreed between the company and the client/guest or in absence of a special agreement half of the tour/charter price must be made soon after the booking. Where the client/guest cancels a booking in writing before 5 working days of the tour/daycharter a refund of 50% of the deposit made shall be made. In case of a multi day yacht-charter the following per-centages of refund shall apply: 75% before 90 days, 50% before 60 days and 25% before 30 days. Cancellations outside this time frame are considered irregular and the deposit is forfeited. The company reserves the right to cancel bookings for unforeseen reasons. Where the company cancels a booking a full refund will be made. The balance of the tour / charter price payment must always be made and received by the company prior to the tour.
4. Liability
Clients hereby acknowledge, the risk involved in maritime travel and any associated marine activities. Further, that these hazards include, but are not limited to, air expansion injuries, drowning, decompression sickness, slipping or falling while on board a boat, being cut or struck by a boat while in the water, and any other injuries occurring while getting on or off a boat and other perils of the sea. Clients also confirm that they are aware of and appreciate the real dangers and risks associated with travel to Africa, its National Parks or wilderness areas, arising from the presence of wild and dangerous animals, reptiles, fish and birds and the real risk of suffering bodily harm, injury or death or loss of property which may arise as a result of an encounter with a / or the presence of wild animals and or reptiles, fish and birds. Hospitals and medical facilities might at times be far away to reach. The client undertakes all activities and travel at his / her own risk. Such risk could include injury, disease or death. The client and the Agent agrees and concedes that the company and its members and employees shall not be responsible for loss or damage to property or injury or illness to the client or loss of life or consequential damages which might occur from any cause whatsoever.
5. Claims and Complaints.
In the unlikely event that the client has a complaint it must firstly be taken up with the crew or management on site. If the client has any further complaint then they must lodge this in writing to the company within 10 (ten) days of the tour end. If these procedures are not followed then the
6. Company Responsibility and Rights
The information given in any brochure, leaflets, website and advertising is given in good faith but cannot be guaranteed to each and every detail. The client guest accept to accord flexibility in interpretation of information given
7. Tachnical Clause
In remote areas of this world it is sometimes difficult to keep all technical standards up to date and obtain spares efficiently and timely. Whilst we endeavour our best to maintain highest possible standards it can still happen at times that changes of programs, delays or inconvenience may be experienced in rare isolated cases. The client / guest takes note and agrees to such a possibility which will not entitle to a claim against the company nor a refund. Where the disturbance would be to a significant scale the company will compensate at its discretion. The same applies to adverse weather conditions.
8. Severability
Should any of the terms and conditions of this agreement be held to be invalid, unlawful or unenforceable, such terms and conditions will be severable from the remaining terms and conditions, which will continue to be valid and enforceable. If any term or condition held to be invalid is capable of amendment to render it valid, the parties agree to negotiate an amendment to remove the invalidity.
9. Relevant law
This agreement (including its validity, existence and implementation, the interpretation and application of its provisions, the respective rights and obligations of the parties in terms of and arising out of the conclusion, breach and termination of the provisions of this agreement), shall be interpreted and governed in all respects by the laws of the Republic of Zanzibar
10. Summary: All clients and their agents confirm that they have read and abide by the aforementioned and agree to the terms and conditions therein contained. The conditions of carriage of the company are an integral part of this agreement. All clients are aware or must be made aware that they are making a booking at their own risk and waive any claims that they might have in regard to injury, loss or death which are not accepted by the company’s insurance and which might occur due to any causes whatsoever against the company. The client and any clients Agent further binds their dependents, heirs, executors, administrators and assigns to the terms and conditions of this agreement, and indemnify the company, its members, associates, employees, representatives, organisers, helpers and agents from all liability for any or all claims whatsoever and howsoever arising that are not accepted by the company’s insurance
